Pursuant to the passing of legislature in the 2024 Legislative Session, filing fees have increased to $105.00 effective July 1, 2024.
Effective September 9 th , 2021, the Magistrate Court of Walton County will no longer accept filings through NCOURT. We do have an alternative to online filing through the following link: https://www.ez-filing.net/magistrate. Please follow the instructions provided. We apologize for any inconvenience.
Effective December 18, 2023, you can access a case search now at https://waltonmagistratecourt.com/WebCaseManagement/ as the web address was updated. There will still be a fee to print a copy. Thank you for your cooperation in this matter.
Pursuant to HB492, relating to Dispossessory Proceedings, the following is effective July 1, 2019:
Subject to subsection (a) of this Code section and Code Section 44-7-59, applications for execution of a writ of possession shall be made within 30 days of issuance of the writ of possession unless such application for said writ is accompanied by an affidavit showing good cause for the delay in applying for execution of the writ. The failure to execute a writ in conformity with this Code section shall require the applicant to apply for a new writ. (e) Nothing in this Code section shall require a sheriff, constable, or marshal to execute a writ of possession within 30 days from the issuance of any order granting a writ of possession, or the issuance, application, or request for the execution of the writ of possession.
O.C.G.A. 16-5-47 was amended this year and now requires that all government entities include a human trafficking notice on the homepage of their websites. Below are relevant portions of the code section and a link to the GBI notice.
(a) (5.2) Government entities are defined as: "Government entity" means an office, agency, authority, department, commission, board, body, division, instrumentality, or institution of the executive, legislative, or judicial branch of the state government and any county, municipal corporation, or consolidated government within this state."
(c) The Georgia Bureau of Investigation shall develop a model notice that is available for download from its Internet website. Such notice shall be at least 8 1/2 inches by 11 inches in size and printed in a 16 point font in English, Spanish, and any other language deemed appropriate by the director of the Georgia Bureau of Investigation. Such model notice shall provide information giving individuals a method to contact the National Human Trafficking Hotline and the Statewide Georgia Hotline for Domestic Minor Trafficking.
(c.1) Every government entity shall, on the homepage of its website, provide an identified hyperlink to the model notice that is on the Georgia Bureau of Investigation website as provided for in subsection (c) of this Code section.
As of April 13th, 2018, our office will only be able to take in twelve Dispossessory Filings per entity or business each day.
